Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ColiveWork, operated by Woodia Spain (“ColiveWork”, “we”, “us”). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the service.

1.Description of service

ColiveWork is an online marketplace that connects coliving space operators (“Hosts”) with remote professionals seeking mid-term accommodation (“Residents”). ColiveWork is not a landlord, property manager, real estate agent, or party to any rental agreement. We provide the technology platform; all agreements for accommodation are directly between Hosts and Residents.

2.Eligibility

You must be at least 18 years old to use ColiveWork. By registering, you represent that all information you provide is accurate and complete, and that you have the legal capacity to enter into binding agreements.

3.Account registration and security

  • One account per person. Corporate accounts require prior written approval.
  • You are responsible for maintaining the confidentiality of your password.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4.For residents

  • Booking requests: submitting a request does not guarantee accommodation. The Host must approve the booking.
  • Accuracy: your profile, professional information, and application messages must be truthful.
  • Payments: once a booking is confirmed, payment is processed via Stripe according to the agreed terms.
  • Cancellations: cancellation policies are set by each Host and displayed on the listing. Review them before booking.
  • Conduct: you agree to treat the Host's property and community with respect and comply with house rules.

5.For hosts

  • Listing accuracy: all information in your listing (photos, descriptions, pricing, availability) must be accurate and current.
  • Platform fee: ColiveWork charges a 12% fee on the total booking value for confirmed bookings. This fee is deducted before payout.
  • Payouts: processed via Stripe Connect within 7 business days of the resident's move-in date.
  • Vetting: ColiveWork may review and remove listings that do not meet our quality standards.
  • Taxes: Hosts are solely responsible for determining and fulfilling their tax obligations.

6.Prohibited conduct

You agree not to:

  • Post false, misleading or fraudulent listings or profiles.
  • Circumvent the platform fee by arranging bookings outside ColiveWork.
  • Harass, threaten or discriminate against other users.
  • Use the platform for any unlawful purpose.
  • Scrape, copy or redistribute platform content without permission.
  • Impersonate another person or entity.

7.Intellectual property

ColiveWork and its logos, design, and software are owned by Woodia Spain. User-generated content (listing photos, descriptions) remains owned by the user, but you grant ColiveWork a non-exclusive, royalty-free license to use, display and distribute such content on the platform.

8.Disclaimers

ColiveWork does not verify the accuracy of all listing information, screen all users, or guarantee the quality of any accommodation. The platform is provided “as is”. We make no warranties, express or implied, regarding the fitness of any listing for your particular needs.

9.Limitation of liability

To the maximum extent permitted by applicable law, ColiveWork shall not be liable for: disputes between Hosts and Residents, damage to personal property, personal injury, loss of income, or any indirect or consequential damages arising from use of the platform. Our total liability shall not exceed the fees paid by you to ColiveWork in the 12 months preceding the claim.

10.Indemnification

You agree to indemnify and hold harmless ColiveWork and its officers, employees and agents from any claims, damages or expenses arising from your use of the platform or violation of these Terms.

11.Dispute resolution

We encourage users to resolve disputes directly. If you have a complaint, contact support@colivework.co. We will attempt to mediate in good faith. Unresolved disputes shall be subject to the jurisdiction of the courts of A Coruña, Spain.

12.Governing law

These Terms are governed by the laws of Spain. The UN Convention on Contracts for the International Sale of Goods does not apply.

13.Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the platform after changes constitutes acceptance.
